New Jersey DWI Laws

Driving while intoxicated is defined in New Jersey as a person who “operates a motor vehicle or permits another to operate a motor vehicle while under the influence of intoxicating liquor, narcotic, or habit producing drug” (N.J. Statutes Annotated § 39:4-50(a)).

Driving with a blood alcohol concentration or BAC of 0.08 percent or more is also considered driving while intoxicated. The legal BAC limit is reduced in certain circumstances, such as for commercial drivers, bus drivers and drivers under the legal drinking age of 21.

What Are the Penalties for a DWI in New Jersey?

A first-offense DWI conviction in New Jersey is punishable with fines, jail time of up to 30 days and driver’s license suspension for three months. If the driver’s BAC level is above 0.10 percent, the penalties are enhanced to higher fines and driver’s license suspension for seven months to one year. A second offense DWI within 10 years comes with harsher penalties, including incarceration of up to 90 days, driver’s license suspension for two years and community service.
