What Is the New Jersey Workers’ Compensation Program?

These benefits are offered to workers without requiring them to prove fault or negligence (a lack of proper care). The workers’ comp program covers injuries and accidents, occupational diseases, and repetitive strain injuries.

Under state law in New Jersey, all employers are required to carry workers’ compensation insurance. Virtually everyone who works for wages is covered by the state’s workers’ compensation system, regardless of the number of employees at the company. However, there is an exception for independent contractors.

  • Disability benefits: if a worker suffers a disability, he or she is eligible for long-term wage replacement benefits to make up for the inability to work. There are benefits available for permanent total disability (PTD), permanent partial disability (PPD), temporary partial disability (TPD) and temporary total disability (TTD).
  • Death benefits: if a worker passes away from a work-related injury or illness, workers’ compensation insurance can pay dependents (such as a surviving spouse or children) weekly payments of 70 percent of the deceased person’s wages, as well as up to $3,500 in funeral costs.

Note that some of these benefits are subject to state limits. How long workers’ comp benefits will last depends on the case. Permanent total disability benefits, for example, can last for up to 450 weeks or continue indefinitely. There is a seven-day waiting period before temporary disability workers’ comp benefits begin, but medical benefits do not have a waiting period.

How to File a Workers’ Compensation Claim in New Jersey

Your employer will contact its workers’ compensation insurance carrier to file a claim for you. If there is a dispute, you could also file the claim yourself with the New Jersey Division of Workers’ Compensation.
